ONLY IF YOU ACCEPT THE TERMS AND CONDITIONS OF THIS AGREEMENT FIRST CAN YOU FINISH YOUR ORDER FOR THE REQUESTED SOFTWARE.
AS LONG AS YOU DOWNLOAD, INSTALL, COPY, OR USE THE SOFTWARE FROM ARKTHINKER, YOU AGREE TO BE BOUND BY THIS AGREEMENT, WHICH IS THE COMPLETE AGREEMENT BETWEEN YOU AND ARKTHINKER ABOUT THE SOFTWARE AND SUPERSEDES ANY PRIOR ADVICE, AGREEMENT, REPRESENTATION, OR UNDERSTANDING BETWEEN THE PARTIES. THIS AGREEMENT INCLUDES AN ARBITRATION PROVISION.
ArkThinker and its subsidiaries own all intellectual property rights in the Software, which is protected by copyright and other intellectual property laws. Furthermore, all intellectual property rights in and to the content accessible through the Software are the property of the respective content owners. And it may also be protected by applicable copyright or other intellectual property laws and treaties. This Agreement does not give you the right to use such content. ArkThinker reserves all rights that have not been expressly given to you. The Software is exclusively licensed to you, not sold to you. This product may not be copied, published, transmitted, modified, or created derivative works from, publicly displayed, or publicly performed. Except as specifically specified below, reproduction or storage of the Software is prohibited without the prior written authorization of ArkThinker.
ArkThinker hereby grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the Software on as many computers as you have paid for. Running a properly licensed copy of the operating system for which the Software is designed, whether for personal or internal corporate business usage. You may make a backup copy of the Software for your records, but only if the original has not been used. You cannot remove or alter the copyright notices on any copy of the Software. You may not use the Software on a computer network or let other people use it at the same time. You are not allowed to rent, lease, or transfer the Software. Unless otherwise authorized by law, you may not reverse engineer, decompile, or disassemble the Software or attempt to do so. Any extra code delivered by ArkThinker in connection with any mutually agreed-upon support services will be deemed part of the Software. And it will be subject to the terms and conditions of this Agreement. To use the Software, you must follow all relevant laws.
Unless otherwise stated, you may only use the Software for evaluation purposes for a certain period beginning with the date of initial installation if you received, downloaded, and installed a trial version of the Software or are granted an evaluation license of the Software. It is expressly forbidden to use the Software for any other purpose or after expired appropriate evaluation time.
You are only permitted to install one copy of the licensed Software on a single device. The principal user of the device on which the Software is licensed must be you. This Agreement governs all installations of the Licensed Software. It is not permitted to install licensed Software on two or more devices. You can purchase additional licenses if you want to install the Software on two or more devices. You will be fully liable for any and all costs incurred in installing and using the Licensed Software.
Unless otherwise specified in this Agreement, ArkThinker will protect your privacy at all times. To improve the Software and user experience, ArkThinker may gather and analyze information about how the Software is used. But ArkThinker will not share, sell, trade, or rent the information to others. If you do not want to utilize this service, you may disable it during installation.
There may be technical measures to prevent unlicensed or unlawful use of the Software. ArkThinker may set a restriction on the number of times that a Licensee can install/uninstall the Software on a system, the number of devices, and the duration of the purchased license. The Software may need activation during installation. If the activation is not followed, the Software may only function for a limited period. The Software may also stop operation if the activation is incomplete. If the Licensee has any problems throughout the activation procedure, please contact ArkThinker Support Team.
Without ArkThinker's prior permission, Licensee may not rent, lease, loan, sell, assign, sublicense, disseminate, or transfer the Licensed Software or the license.
THE INFORMATION AND DOCUMENTS OF ARKTHINKER ARE PROVIDED "AS IS" WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING THE LIMITED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ARKTHINKER MAKES REASONABLE ATTEMPTS TO OFFER CORRECT AND UP-TO-DATE INFORMATION ON THIS WEBSITE; NEVERTHELESS, NO WARRANTY OR REPRESENTATION IS MADE REGARDING ITS ACCURACY OR COMPLETENESS. WITHOUT WARNING, ARKTHINKER MAY ADD, CHANGE, ENHANCE, OR UPDATE THE CONTENT AND DOCUMENTATION ON THIS WEBSITE ON A REGULAR BASIS. ARKTHINKER ACCEPTS NO RESPONSIBILITY FOR ANY INACCURACIES OR OMISSIONS IN THE WEBSITE'S CONTENT. THIS WEBSITE IS USED AT YOUR OWN RISK. IN NO EVENT SHALL AISEESOFT OR ANY OTHER PARTY INVOLVED IN THE CREATION, PRODUCTION, OR DELIVERY OF THE CONTENT OF THIS WEBSITE BE LIABLE TO YOU OR ANY OTHER PERSON UNDER ANY LEGAL THEORY FOR ANY INDIRECT, DIRECT, SPECIAL, INCIDENTAL, OR INDIRECT DAMAGES RESULTING FROM YOUR ACCESS OR USE OF THIS WEBSITE.
You are not permitted to use, export, or re-export the Licensed Software to any nation or territory recognized by the United Nations or the United States. You represent and warrant that you are not situated in any such nation by using the Licensed Software.
You should pay all sales, use, and similar taxes related to the Licensed Software.
ArkThinker may terminate this Agreement without prejudice to any other rights if you fail to comply with this Agreement. In that case, you must destroy any copies of the Software that you have.
ARKTHINKER PROHIBITS YOU FROM USING THE SOFTWARE IN ANY WAY THAT VIOLATES LOCAL LAWS OR INFRINGES ON THE RIGHTS OR INTELLECTUAL PROPERTY RIGHTS OF ANY THIRD PARTY. IF YOU USE THE SOFTWARE FOR UNLAWFUL ACTIONS OR INFRINGE THE RIGHTS OF OTHERS, YOU WILL BE HELD ACCOUNTABLE FOR THE CONSEQUENCES. PLUS, ADOLESCENTS ARE NOT PERMITTED TO USE ARKTHINKER'S SERVICES TO BROWSE THE CONTENT OF ANY UNLAWFUL, OBSCENE, PORNOGRAPHIC, OR OTHER VIOLATIONS OF PUBLIC ORDER AND MORALITY. DO NOT INSTALL OR USE THIS SOFTWARE PRODUCT IF YOU DO NOT AGREE TO THESE TERMS.
